These Terms of Service govern your access to and use of WalkOff, including the WalkOff mobile application, WalkOff website, WalkOff waitlist, WalkOff Pro, Route Walk, leaderboards, achievements, friend features, profile features, challenge features, subscription features, and any other services provided by WalkOff Fitness, LLC. In these Terms, “WalkOff,” “we,” “us,” and “our” refer to WalkOff Fitness, LLC. “You” and “your” refer to the person accessing or using WalkOff. By creating an account, joining the waitlist, visiting the website, using the app, using Route Walk, connecting fitness data, subscribing to WalkOff Pro, or otherwise using WalkOff, you agree to these Terms. If you do not agree to these Terms, you may not use WalkOff. You should also read our Privacy Policy, which explains how WalkOff collects, uses, stores, shares, and deletes information. For support, privacy requests, account deletion requests, safety concerns, or legal questions, contact WalkOff at info@walkoff.com.

1. Acceptance of These Terms

    By using WalkOff, you confirm that you have read, understood, and agreed to these Terms. These Terms are a legal agreement between you and WalkOff Fitness, LLC. If you use WalkOff on behalf of another person, organization, company, or legal entity, you confirm that you have permission to accept these Terms on their behalf. If you do not agree to these Terms, you must not create an account, use the app, join the waitlist, access WalkOff Pro, use Route Walk, participate in leaderboards, or use any WalkOff service.

2. Minimum Age

    WalkOff is intended only for users who are at least 14 years old. You may not create an account, join the waitlist, use the app, or use WalkOff services if you are under 14 years old. If you are between 14 and 17 years old, you may use WalkOff only with permission from a parent or legal guardian. By using WalkOff as a user under 18, you confirm that your parent or legal guardian has allowed you to use WalkOff and agreed that you may follow these Terms. If the laws in your country, state, province, or region require parent or guardian consent for users older than 14, you may use WalkOff only if that legally required consent has been given. WalkOff may suspend or delete accounts that appear to belong to users under the allowed age.

3. Parent and Guardian Responsibility

    If you are a parent or legal guardian and you allow a minor to use WalkOff, you are responsible for supervising that minor’s use of the app. You agree that the minor must follow these Terms. You are responsible for helping the minor understand safe walking behavior, safe route sharing, appropriate profile information, subscription decisions, privacy settings, and account safety. If you believe a minor has created a WalkOff account without proper permission, contact WalkOff at info@walkoff.com.

4. What WalkOff Is

    WalkOff is a competitive walking, fitness, motivation, and progress-tracking app. WalkOff may allow users to track steps, earn XP, build streaks, unlock achievements, climb rank tiers, compete on leaderboards, complete challenges, add friends, track calories, use Route Walk, view walking summaries, share progress, and access optional premium features through WalkOff Pro. WalkOff is designed to make walking more fun, competitive, and motivating. WalkOff is not designed to replace medical advice, professional fitness advice, emergency services, or personal judgment.

5. WalkOff Is Not Medical Advice

    WalkOff is not a doctor, medical provider, hospital, emergency service, dietitian, therapist, personal trainer, health care provider, or medical device. WalkOff does not diagnose, treat, cure, prevent, monitor, or manage any disease, injury, disorder, or medical condition. Any step counts, calorie estimates, walking distance estimates, walking speed estimates, XP totals, streaks, rank progress, route summaries, AI suggestions, fitness tips, or progress trends are provided for general informational and motivational purposes only. You are responsible for using WalkOff safely. You should stop walking or exercising if you feel unsafe, dizzy, sick, injured, in pain, short of breath, unusually tired, or uncomfortable. If you have a medical condition, health concern, injury, or question about fitness, you should speak with a doctor, parent, guardian, or trusted adult before using WalkOff.

6. No Emergency Use

    WalkOff is not an emergency service. You should not rely on WalkOff to contact emergency services, detect emergencies, monitor your safety, or protect you during walks. If you are in danger or need emergency help, you should contact emergency services directly. WalkOff cannot guarantee that location tracking, route tracking, notifications, friend features, or account features will be available, accurate, or fast enough to help in an emergency.

7. Account Creation

    To use certain WalkOff features, you may need to create an account. When you create an account, you agree to provide accurate information and keep your account information updated. You may not create an account using false information, another person’s information, a fake identity, or an identity that you do not have permission to use. You may not create accounts to impersonate someone else, avoid a ban, manipulate leaderboards, abuse referrals, harass users, or cheat the system. WalkOff may refuse, suspend, or delete accounts that violate these Terms or create safety, privacy, legal, or security concerns.

8. Account Security

    You are responsible for keeping your account login information safe. You should not share your password, login code, account access, or private authentication information with anyone. You are responsible for activity that happens through your account unless the activity happened because of WalkOff’s failure to use reasonable security measures. If you believe someone accessed your account without permission, contact WalkOff at info@walkoff.com as soon as possible. WalkOff may temporarily restrict access to an account if we believe the account has been compromised or used in a way that creates risk.

9. Usernames, Display Names, Bios, and Profiles

    You are responsible for the username, display name, bio, profile picture, and other profile content you choose. You may not use profile content that is hateful, abusive, threatening, sexual, violent, discriminatory, harassing, misleading, spammy, impersonating, illegal, or unsafe. You may not include private information in public profile areas, including your home address, school name, phone number, full legal name, private routine, exact location, or someone else’s personal information. WalkOff may remove, block, or require changes to usernames, display names, bios, profile photos, or profile content that violate these Terms or create safety concerns.

10. Public and Social Features

    WalkOff includes competitive and social features. Your username, display name, profile picture, rank, XP, streak, achievements, leaderboard placement, challenge progress, and certain profile stats may be visible to other users. You understand that when you use social, leaderboard, challenge, friend, achievement, or sharing features, some of your information may be shown to other users or to people outside WalkOff if you choose to share it. You are responsible for what you choose to make public or share.

11. Route Walk

    Route Walk is a feature that may allow you to start a walk, track your route using location, view where you went, end your walk, and see a completed walk summary. A completed walk summary may include a route map, an orange route line, distance, walking time, average speed, steps, estimated calories burned, XP earned, achievements, and WalkOff branding. Route Walk depends on your device, GPS, location permissions, battery level, signal quality, operating system, and other factors. WalkOff does not guarantee that Route Walk will always be accurate, complete, available, or error-free.

12. Location Safety

    You are responsible for using location features safely. You should not share routes that reveal your home, school, workplace, gym, private routine, or other sensitive locations. You should review any route summary before sharing it. You should not post walk routes publicly if they reveal where you live, where you go to school, or where you spend time regularly. WalkOff may provide privacy features such as route previews, private sharing, or hiding route details, but you remain responsible for your own sharing decisions. WalkOff is not responsible for harm that results from you publicly sharing private location information.

13. Walking Safety

    You are responsible for paying attention to your surroundings while walking. You should not stare at your phone while crossing streets, walking near traffic, walking at night, walking in unsafe areas, using stairs, biking, driving, or doing anything that requires full attention. You should follow traffic laws, local rules, school rules, parent or guardian instructions, and common sense. You should not walk in unsafe places, unsafe weather, or dangerous conditions just to earn steps, XP, streaks, achievements, rank progress, or leaderboard placement. WalkOff is meant to encourage walking, not unsafe behavior.

14. Fitness Accuracy

    WalkOff may use device sensors, GPS, Apple Health, wearable data, user-entered information, formulas, and algorithms to estimate steps, distance, speed, calories burned, XP, streaks, and progress. These estimates may be inaccurate. GPS may jump, distance may be wrong, speed may be unrealistic, steps may be undercounted or overcounted, and calorie estimates may not match your actual body or activity. WalkOff may filter unrealistic walking speeds, suspicious GPS jumps, fake steps, or activity that appears impossible. WalkOff may adjust, reject, or ignore activity data when we believe it is inaccurate, fake, abusive, or unfair.

15. XP, Streaks, Ranks, and Tiers

    WalkOff may use XP, streaks, achievements, rank tiers, and leaderboards to motivate users. Rank tiers may include Bronze, Silver, Gold, Diamond, Rainbow, Nightmare, or other tiers added later. WalkOff may change XP rules, streak rules, tier thresholds, leaderboard rules, achievements, challenge rules, bonuses, or premium boosts at any time to improve balance, prevent cheating, fix bugs, or improve the app. WalkOff does not guarantee that any rank, achievement, streak, XP total, badge, leaderboard placement, or progress status will remain unchanged forever. WalkOff may correct, reset, or remove progress if it was earned through cheating, errors, bugs, GPS spoofing, fake activity, or abuse.

16. Leaderboards

    WalkOff leaderboards are for motivation, competition, and entertainment. Leaderboard placement may be based on steps, XP, weekly performance, global performance, friends, challenges, rank, or other criteria. WalkOff may remove users from leaderboards, adjust leaderboard scores, reset suspicious activity, or restrict accounts if WalkOff believes a user is cheating, using fake steps, spoofing GPS, manipulating devices, abusing bugs, using bots, creating fake accounts, harassing users, or violating these Terms. WalkOff does not guarantee that leaderboards will always be accurate, available, fair, or error-free.

17. Achievements

    WalkOff may allow users to unlock achievements based on activity, streaks, rank, challenges, social actions, or other app progress. Achievements are for motivation and entertainment. WalkOff may change, remove, rename, redesign, rebalance, or reset achievements at any time. WalkOff may remove achievements if they were earned through cheating, bugs, fake activity, GPS spoofing, or violations of these Terms.

18. Friends and Social Interaction

    WalkOff may allow users to send friend requests, accept friend requests, remove friends, block users, view friend leaderboards, and compare progress. You may not use friend features to harass, threaten, stalk, bully, pressure, impersonate, shame, embarrass, or target another person. You may not use WalkOff to pressure someone into unsafe walking, extreme exercise, unhealthy habits, sharing location, sharing private information, or participating in challenges they do not want to join. WalkOff may restrict or remove social features from accounts that create safety concerns.

19. Prohibited Conduct

    You agree not to misuse WalkOff. You may not use WalkOff to harass, threaten, bully, stalk, impersonate, shame, exploit, abuse, discriminate against, or harm another person. You may not use hate speech, slurs, threats, sexually explicit content, graphic violent content, illegal content, spam, scams, or content that endangers minors. You may not upload content that invades someone else’s privacy, reveals someone else’s personal information, or uses someone else’s image without permission. You may not interfere with WalkOff’s systems, bypass security, reverse engineer the app, scrape data, create bots, use automation to manipulate the app, or attempt to access accounts or data that do not belong to you.

20. Prohibited Language and Moderation

    WalkOff may block or remove abusive language, slurs, hate speech, threats, sexual language, violent language, harassment, bullying, and attempts to bypass moderation filters. WalkOff may block obvious misspellings, spacing tricks, number substitutions, symbol substitutions, and other attempts to evade filters. WalkOff may review usernames, display names, bios, profile photos, walk captions, friend content, challenge content, support messages, and other user-generated content. WalkOff may remove content, restrict features, suspend accounts, delete accounts, or take other action when content violates these Terms or creates safety concerns.

21. Cheating and Fair Play

    You may not cheat, fake steps, spoof GPS, manipulate activity data, use bots, use emulators to fake movement, exploit bugs, abuse premium boosts, create fake accounts, abuse referrals, manipulate leaderboards, or use any method that gives unfair progress. WalkOff may use technical systems, activity review, GPS analysis, speed filters, device signals, and other methods to detect cheating. WalkOff may remove XP, reset streaks, remove achievements, remove leaderboard placement, restrict features, suspend accounts, or delete accounts if we believe cheating or unfair activity occurred.

22. User Content

    “User Content” means any content you upload, create, submit, display, or share through WalkOff, including usernames, display names, bios, profile photos, walk captions, route summaries, challenge content, support messages, feedback, screenshots, reports, and other materials. You are responsible for your User Content. You confirm that you own your User Content or have permission to use it. You may not upload User Content that violates someone else’s rights, including copyright, trademark, privacy, publicity, or other legal rights. WalkOff may remove or restrict User Content that violates these Terms or creates legal, safety, privacy, or security concerns.

23. License You Give WalkOff

    By posting, uploading, or submitting User Content to WalkOff, you give WalkOff a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, display, resize, modify, process, transmit, and use that User Content only as needed to operate, improve, promote, protect, and provide WalkOff. This license allows WalkOff to display your profile picture, show your leaderboard entry, show achievements, create share cards, process support requests, moderate content, and operate app features. This license ends when your User Content is deleted from WalkOff, except where continued use is reasonably necessary for legal compliance, safety, backups, records, moderation, or content you already shared with others.

24. WalkOff Intellectual Property

    WalkOff, including the app name, logo, designs, visuals, badges, rank art, tier art, Nightmare visuals, interface designs, code, features, text, graphics, branding, animations, and other materials created by or for WalkOff, belongs to WalkOff Fitness, LLC or its licensors. You may not copy, reproduce, modify, sell, license, distribute, reverse engineer, or use WalkOff’s intellectual property without permission. You may use WalkOff only for personal, lawful, non-commercial use unless WalkOff gives you written permission otherwise.

25. Feedback

    If you send WalkOff ideas, suggestions, bug reports, feature requests, designs, comments, or feedback, you allow WalkOff to use that feedback without owing you payment, credit, ownership, or compensation. WalkOff may use feedback to improve the app, design new features, fix bugs, create content, or change the service. You should not send confidential information as feedback.

26. WalkOff Pro

    WalkOff may offer optional premium features through WalkOff Pro. WalkOff Pro may include advanced progress stats, premium rank visuals, extra insights, AI-powered tools, advanced calorie features, additional customization, detailed charts, progress predictions, or other premium features. WalkOff may change WalkOff Pro features over time. WalkOff does not guarantee that every premium feature will always remain available, unchanged, or compatible with every device. If a premium feature becomes unavailable, WalkOff may replace, modify, or remove it as allowed by law and platform rules.

27. Subscriptions and Purchases

    If WalkOff Pro is offered through the Apple App Store or another app store, your purchase may be processed by that app store, not directly by WalkOff. Your subscription may automatically renew unless you cancel it according to the app store’s rules. You are responsible for reviewing the price, billing period, renewal terms, free trial terms, and cancellation terms before purchasing. WalkOff does not receive your full credit card number from Apple. WalkOff may receive limited subscription status information so we can unlock Pro features, provide support, prevent abuse, and maintain records.

28. Canceling a Subscription

    If your WalkOff Pro subscription is managed by Apple, you must cancel it through your Apple account settings. Deleting the WalkOff app does not cancel your subscription. Logging out of WalkOff does not cancel your subscription. Deleting your WalkOff account does not automatically cancel your subscription. Canceling your subscription may stop future renewals, but it may not automatically refund past charges. Refunds are handled by the app store or payment provider when applicable.

29. Free Trials, Promotions, and Early Access

    WalkOff may offer free trials, early access bonuses, promotional codes, discounts, referral rewards, or limited-time offers. WalkOff may change, limit, cancel, or end promotions at any time unless prohibited by law. Promotions may have eligibility rules, expiration dates, account limits, geographic limits, or other conditions. WalkOff may deny, revoke, or cancel promotional benefits if we believe a user is abusing the offer, creating fake accounts, violating these Terms, or committing fraud.

30. Refunds

    If purchases are processed through Apple or another app store, refunds are generally handled by that app store according to its rules. WalkOff cannot guarantee that a refund request will be approved. WalkOff may help direct users to the correct refund process when possible, but WalkOff does not control Apple’s refund decisions or another platform’s refund decisions.

31. Account Deletion

    WalkOff allows users to request account deletion. WalkOff should provide an account deletion option inside the app, such as in the Me section, account settings, or privacy settings. You may also contact info@walkoff.com for account deletion help. Deleting your account may remove or anonymize account information, profile information, progress information, leaderboard information, and other data connected to your account unless WalkOff needs to keep certain information for legal compliance, accounting, fraud prevention, dispute resolution, security, safety, or enforcement. Deleting the app from your phone does not delete your account. Logging out does not delete your account. Canceling WalkOff Pro does not delete your account. Deleting your account does not automatically cancel an App Store subscription.

32. Logout

    WalkOff may allow you to log out from the Me section or account settings. Logging out signs you out of WalkOff on that device. Logging out does not delete your account, delete your data, cancel your subscription, remove your leaderboard history, or erase content you already shared. You are responsible for logging out if you use WalkOff on a shared device.

33. Privacy Policy

    WalkOff’s Privacy Policy explains how WalkOff collects, uses, stores, protects, shares, and deletes information. By using WalkOff, you also agree that WalkOff may handle your information as described in the Privacy Policy. If you do not agree with the Privacy Policy, you should not use WalkOff. If these Terms and the Privacy Policy discuss the same topic differently, the Privacy Policy controls how personal information is handled, and these Terms control app rules, user conduct, subscriptions, account rules, and legal responsibilities.

34. Third-Party Services

    WalkOff may use third-party services such as app stores, Apple Health, authentication providers, cloud hosting providers, database providers, map providers, analytics providers, crash reporting providers, email providers, customer support tools, payment processors, and social sharing platforms. Third-party services may have their own terms and privacy policies. WalkOff is not responsible for third-party terms, privacy practices, outages, errors, billing decisions, refund decisions, account decisions, or content. Your use of third-party services may be subject to their separate rules.

35. Apple Health and Fitness Data

    If WalkOff connects with Apple Health, HealthKit, Apple Watch, or another fitness service, you must give permission before WalkOff can access that data. WalkOff may use connected fitness data to provide app features such as step tracking, XP, streaks, achievements, route summaries, progress tracking, and leaderboards. WalkOff does not sell Apple Health data and does not use Apple Health data for advertising. You can change Apple Health permissions in your device settings. If you remove permission, some WalkOff features may stop working or become less accurate.

36. AI Features

    WalkOff may include AI-powered features, such as AI calorie scanning, AI meal suggestions, AI route summaries, AI progress insights, AI fitness tips, AI moderation, or AI support. AI outputs may be inaccurate, incomplete, or inappropriate. You should not rely on AI features as medical advice, nutrition advice, legal advice, mental health advice, emergency guidance, or professional advice. You are responsible for how you use AI outputs. WalkOff may modify, limit, or remove AI features at any time.

37. App Updates and Changes

    WalkOff may update, modify, redesign, limit, suspend, or discontinue features at any time. WalkOff may change XP rules, rank thresholds, tier visuals, achievement conditions, premium features, challenge rules, leaderboard rules, Route Walk features, friend features, or other parts of the app. WalkOff may make changes to fix bugs, improve performance, prevent cheating, follow laws, comply with app store rules, improve safety, or improve the user experience. WalkOff does not guarantee that any feature will always be available or unchanged.

38. Availability

    WalkOff may not always be available. The app may be interrupted by maintenance, bugs, internet problems, server issues, app store issues, device problems, operating system changes, third-party service outages, or other causes. WalkOff does not guarantee that the app will be uninterrupted, secure, accurate, or error-free. WalkOff may temporarily or permanently restrict access to features for maintenance, security, legal, or safety reasons.

39. Suspension and Termination

    WalkOff may suspend, restrict, or delete your account if we believe you violated these Terms, created legal risk, created safety risk, cheated, abused the app, harassed users, used prohibited content, misused subscriptions, created fake accounts, manipulated leaderboards, or harmed WalkOff or other users. WalkOff may also suspend or delete accounts when required by law or platform rules. You may stop using WalkOff at any time. You may request account deletion according to the Privacy Policy and app settings.

40. Effect of Termination

    If your account is suspended, restricted, or deleted, you may lose access to your account, profile, XP, streaks, achievements, leaderboard placement, friends, Route Walk history, subscription-linked features, and other app data. WalkOff is not required to restore deleted or suspended progress unless required by law. Some information may be retained as needed for legal compliance, accounting, fraud prevention, security, dispute resolution, moderation, or enforcement.

41. Reporting Users and Content

    WalkOff may allow users to report profiles, usernames, bios, profile pictures, route content, cheating, harassment, threats, abuse, or other concerns. You should use reporting tools honestly and only for real concerns. You may not abuse reporting tools to harass users, silence users, create false claims, or manipulate competition. WalkOff may review reports and decide what action is appropriate. WalkOff is not required to take every action requested by a reporting user.

42. Copyright and Intellectual Property Complaints

    If you believe content on WalkOff violates your copyright, trademark, privacy rights, publicity rights, or other legal rights, you may contact WalkOff at info@walkoff.com. Your message should clearly identify the content, explain your rights, provide contact information, and explain why you believe the content should be removed. WalkOff may remove content that appears to violate rights or create legal risk. WalkOff may terminate repeat infringers when appropriate.

43. Disclaimers

    WalkOff is provided “as is” and “as available.” WalkOff does not promise that the app will always work, always be accurate, always be available, always be secure, or always meet your expectations. WalkOff does not promise that step counts, route maps, GPS data, calorie estimates, speed estimates, XP, ranks, streaks, achievements, progress trends, AI outputs, or leaderboard placements will be accurate or error-free. WalkOff does not promise that every bug will be fixed or that every feature will remain available. You use WalkOff at your own risk, subject to the protections that cannot be excluded under applicable law.

44. Limitation of Liability

    To the fullest extent allowed by law, WalkOff Fitness, LLC and its owners, employees, contractors, partners, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost data, lost progress, lost XP, lost streaks, lost achievements, lost leaderboard placement, lost profits, subscription issues, device problems, route errors, GPS errors, injury from unsafe walking, or harm caused by user-shared content. WalkOff’s total liability for any claim will be limited to the amount you paid WalkOff in the 12 months before the claim, or 100 dollars, whichever is greater, unless the law requires a different amount. Some places do not allow certain limitations of liability, so some of these limits may not apply to you.

45. User Responsibility and Indemnification

    To the fullest extent allowed by law, you agree to be responsible for claims, damages, losses, liabilities, costs, and expenses that arise from your misuse of WalkOff, your violation of these Terms, your User Content, your cheating or abuse, your violation of someone else’s rights, your unsafe route sharing, your unsafe walking choices, or your violation of law. This means you may be responsible for costs WalkOff faces because of your actions. This section does not apply where prohibited by law.

46. Governing Law

    These Terms are governed by the laws of [Insert State Where WalkOff Fitness, LLC Is Formed], without regard to conflict of law rules, unless the laws where you live require a different rule. You should replace this bracketed section with the state where WalkOff Fitness, LLC was legally formed. If WalkOff Fitness, LLC was formed in New York, use New York. If it was formed in another state, use that state.

47. Dispute Resolution

    If you have a dispute with WalkOff, you agree to first contact WalkOff at info@walkoff.com and try to resolve the issue informally. Your message should explain the problem, the account involved, and what you believe would resolve the issue. WalkOff will try to review and respond reasonably. If the dispute cannot be resolved informally, the dispute will be handled according to applicable law and the governing law section of these Terms. WalkOff may update this section later if it adopts a more specific dispute resolution process, arbitration provision, or court venue provision.

48. App Store Terms

    If you download WalkOff through the Apple App Store or another app store, your use of WalkOff may also be subject to that app store’s terms, rules, and payment policies. If there is a conflict between these Terms and app store rules, the app store rules may control where required. Apple or another app store may manage subscriptions, renewals, cancellations, refunds, app distribution, and platform-level account issues. WalkOff is not responsible for app store decisions that WalkOff does not control.

49. Changes to These Terms

    WalkOff may update these Terms from time to time. If WalkOff makes material changes, WalkOff may notify users by posting the updated Terms on the website, updating the “Last Updated” date, sending an email, showing an in-app notice, or using another reasonable method. Your continued use of WalkOff after updated Terms become effective means you accept the updated Terms. If you do not agree to the updated Terms, you should stop using WalkOff and may request account deletion.

50. Entire Agreement

    These Terms, together with the Privacy Policy and any additional terms shown to you for specific features, form the agreement between you and WalkOff. If any part of these Terms is found invalid or unenforceable, the remaining parts will continue to apply. WalkOff’s failure to enforce a part of these Terms does not mean WalkOff waives the right to enforce it later. You may not transfer your rights or obligations under these Terms without WalkOff’s permission. WalkOff may transfer its rights or obligations if needed as part of a business transfer, legal reorganization, or operation of the service.

51. Contact

    For support, privacy requests, account deletion requests, safety concerns, legal questions, or questions about these Terms, contact WalkOff at info@walkoff.com. When contacting WalkOff, include your account email, your username if you have one, the issue you are contacting us about, and enough information for us to verify and understand the request. You should not send unnecessary private information.
